MDmind Platform Terms of Use

Welcome to MDmind, an artificial intelligence-based medical decision support platform. By accessing or using the MDmind platform, you agree to these Terms of Use. If you do not agree with any of the provisions contained herein, we recommend that you do not use our services.

1. Definitions

• "Platform" refers to MDmind, including its website, applications and other digital services.
• "User" refers to any person who accesses or uses the MDmind Platform.
• "Health Professional" refers to doctors, nurses and other health professionals duly qualified.
• "Content" refers to any information, text, images, graphics, audio, video or other material made available on the Platform.
• "Artificial Intelligence (AI)" refers to the system that provides responses based on scientific evidence and medical guidelines.

2. Platform Purpose

MDmind's purpose is to provide clinical decision support through artificial intelligence, based on medical guidelines, scientific literature and best practices in medicine. The platform does not replace the evaluation, clinical judgment or final decision of the health professional. The responses generated by AI are based on data available to date and may not reflect more recent information or specific patient contexts.

3. Eligibility and Registration

3.1. Requirements

• Use of the Platform is permitted only for individuals over 18 years of age and duly qualified health professionals, i.e., registered with their respective professional councils (e.g.: CRM, COREN) and in compliance with local regulations.
• The user must provide truthful and updated information when registering on the Platform.

3.2. Account Confidentiality and Security

• The user is responsible for maintaining the security of their account, including passwords and access credentials.
• Any activity performed under the user's account will be their responsibility.
• If you suspect unauthorized access, the user must notify MDmind immediately by email support@mdmind.com.br.

4. Platform Use

4.1. User Responsibilities

• The user agrees to use the Platform ethically and in compliance with applicable laws and regulations.
• It is prohibited to insert, store or share false, inaccurate or misleading information on the Platform.

4.2. Limitations and Disclaimer

• MDmind does not provide medical diagnosis, does not replace consultation with a health professional and should not be used in emergency situations or for immediate clinical decisions.
• Content generated by AI should not be interpreted as definitive treatment recommendation and must always be validated by the health professional based on the patient's clinical context.
• The Platform is not responsible for clinical decisions based exclusively on its responses or for any damages resulting from its inappropriate use.

5. Privacy and Data Protection

MDmind respects user privacy and adopts measures to protect their data, including sensitive health-related information. The processing of personal data is described in our Privacy Policy, which must be read in conjunction with these Terms of Use.

6. Intellectual Property

All rights to Platform content, including software, algorithms, interface and available materials, are the exclusive property of MDmind or its licensors. Use of the Platform does not grant the user any rights over its intellectual property.

7. Modifications to Terms of Use

MDmind may change these Terms of Use at any time, by notifying users by email or platform notice with at least 7 days advance notice. Continued use of the Platform after such changes constitutes acceptance of the new terms.

8. Account Termination and Suspension

MDmind reserves the right to suspend or terminate the user's account in case of violation of these Terms of Use.

9. General Provisions

9.1. Applicable Law

These Terms of Use are governed by the laws of Brazil. Any dispute will be resolved in the courts of São Paulo, Brazil, with waiver of any other, however privileged it may be.
